  《中華人民共和國(guó)進(jìn)出口商品檢驗(yàn)法》已由中華人民共和國(guó)第七屆全國(guó)人民代表大會(huì)常務(wù)委員會(huì)第六次會(huì)議于1989年2月21日通過,現(xiàn)予公布,自1989年8月1日起施行。

  第一章 總 則
  
  第一條 為了加強(qiáng)進(jìn)出口商品檢驗(yàn)工作,保證進(jìn)出口商品的質(zhì)量,維護(hù)對(duì)外貿(mào)易有關(guān)各方的合法權(quán)益,促進(jìn)對(duì)外經(jīng)濟(jì)貿(mào)易關(guān)系的順利發(fā)展,制定本法。
  
  第二條 國(guó)務(wù)院設(shè)立進(jìn)出口商品檢驗(yàn)部門(以下簡(jiǎn)稱國(guó)家商檢部門),主管全國(guó)進(jìn)出口商品檢驗(yàn)工作。國(guó)家商檢部門設(shè)在各地的進(jìn)出口商品檢驗(yàn)機(jī)構(gòu)(以下簡(jiǎn)稱商檢機(jī)構(gòu))管理所轄地區(qū)的進(jìn)出口商品檢驗(yàn)工作。
  
  第三條 商檢機(jī)構(gòu)和國(guó)家商檢部門、商檢機(jī)構(gòu)指定的檢驗(yàn)機(jī)構(gòu),依法對(duì)進(jìn)出口商品實(shí)施檢驗(yàn)。
  
  第四條 國(guó)家商檢部門根據(jù)對(duì)外貿(mào)易發(fā)展的需要,制定、調(diào)整并公布《商檢機(jī)構(gòu)實(shí)施檢驗(yàn)的進(jìn)出口商品種類表》(以下簡(jiǎn)稱《種類表》)。
  
  第五條 列入《種類表》的進(jìn)出口商品和其他法律、行政法規(guī)規(guī)定須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)出口商品,必須經(jīng)過商檢機(jī)構(gòu)或者國(guó)家商檢部門、商檢機(jī)構(gòu)指定的檢驗(yàn)機(jī)構(gòu)檢驗(yàn)。
  
  前款規(guī)定的進(jìn)口商品未經(jīng)檢驗(yàn)的,不準(zhǔn)銷售、使用;前款規(guī)定的出口商品未經(jīng)檢驗(yàn)合格的,不準(zhǔn)出口。
  
  本條第一款規(guī)定的進(jìn)出口商品,經(jīng)收貨人、發(fā)貨人申請(qǐng),國(guó)家商檢部門審查批準(zhǔn),可以免予檢驗(yàn)。
  
  第六條 商檢機(jī)構(gòu)實(shí)施進(jìn)出口商品檢驗(yàn)的內(nèi)容,包括商品的質(zhì)量、規(guī)格、數(shù)量、重量、包裝以及是否符合安全、衛(wèi)生要求。
  
  法律、行政法規(guī)規(guī)定有強(qiáng)制性標(biāo)準(zhǔn)或者其他必須執(zhí)行的檢驗(yàn)標(biāo)準(zhǔn)的進(jìn)出口商品,依照法律、行政法規(guī)規(guī)定的檢驗(yàn)標(biāo)準(zhǔn)檢驗(yàn);法律、行政法規(guī)未規(guī)定有強(qiáng)制性標(biāo)準(zhǔn)或者其他必須執(zhí)行的檢驗(yàn)標(biāo)準(zhǔn)的,依照對(duì)外貿(mào)易合同約定的檢驗(yàn)標(biāo)準(zhǔn)檢驗(yàn)。
  
  第七條 法律、行政法規(guī)規(guī)定由其他檢驗(yàn)機(jī)構(gòu)實(shí)施檢驗(yàn)的進(jìn)出口商品或者檢驗(yàn)項(xiàng)目,依照有關(guān)法律、行政法規(guī)的規(guī)定辦理。
  
  第八條 國(guó)家商檢部門和商檢機(jī)構(gòu)應(yīng)當(dāng)收集和向有關(guān)方面提供進(jìn)出口商品檢驗(yàn)方面的信息。
  
  第二章 進(jìn)口商品的檢驗(yàn)
  
  第九條 本法規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)口商品的收貨人,必須向卸貨口岸或者到達(dá)站的商檢機(jī)構(gòu)辦理進(jìn)口商品登記。對(duì)列入《種類表》的進(jìn)口商品,海關(guān)憑商檢機(jī)構(gòu)在報(bào)關(guān)單上加蓋的印章驗(yàn)放。
  
  第十條 本法規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)口商品的收貨人,應(yīng)當(dāng)在商檢機(jī)構(gòu)規(guī)定的地點(diǎn)和期限內(nèi),向商檢機(jī)構(gòu)報(bào)驗(yàn)。商檢機(jī)構(gòu)應(yīng)當(dāng)在對(duì)外貿(mào)易合同約定的索賠期限內(nèi)檢驗(yàn)完畢,并出具證明。
  
  
  
  第十一條 本法規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)口商品以外的進(jìn)口商品的收貨人,發(fā)現(xiàn)進(jìn)口商品質(zhì)量不合格或者殘損短缺,需要由商檢機(jī)構(gòu)出證索賠的,應(yīng)當(dāng)向商檢機(jī)構(gòu)申請(qǐng)檢驗(yàn)出證。
  
  第十二條 對(duì)重要的進(jìn)口商品和大型的成套設(shè)備,收貨人應(yīng)當(dāng)依據(jù)對(duì)外貿(mào)易合同約定在出口國(guó)裝運(yùn)前進(jìn)行預(yù)檢驗(yàn)、監(jiān)造或者監(jiān)裝,主官部門應(yīng)當(dāng)加強(qiáng)監(jiān)督;商檢機(jī)構(gòu)根據(jù)需要可以派出檢驗(yàn)人員參加。
  
  第三章 出口商品的檢驗(yàn)
  
  第十三條 本法規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的出口商品的發(fā)貨人,應(yīng)當(dāng)在商檢機(jī)構(gòu)規(guī)定的地點(diǎn)和期限內(nèi),向商檢機(jī)構(gòu)報(bào)驗(yàn)。商檢機(jī)構(gòu)應(yīng)當(dāng)在不延誤裝運(yùn)的期限內(nèi)檢驗(yàn)完畢,并出具證明。
  
  對(duì)列入《種類表》的出口商品,海關(guān)憑商檢機(jī)構(gòu)簽發(fā)的檢驗(yàn)證書、放行單或者在報(bào)關(guān)單上加蓋的印章驗(yàn)放。
  
  第十四條 經(jīng)商檢機(jī)構(gòu)檢驗(yàn)合格發(fā)給檢驗(yàn)證書或者放行單的出口商品,應(yīng)當(dāng)在商檢機(jī)構(gòu)規(guī)定的期限內(nèi)報(bào)運(yùn)出口;超過期限的,應(yīng)當(dāng)重新報(bào)驗(yàn)。
  
  第十五條 為出口危險(xiǎn)貨物生產(chǎn)包裝容器的企業(yè),必須申請(qǐng)商檢機(jī)構(gòu)進(jìn)行包裝容器的性能鑒定。生產(chǎn)出口危險(xiǎn)貨物的企業(yè),必須申請(qǐng)商檢機(jī)構(gòu)進(jìn)行包裝容器的使用鑒定。使用未經(jīng)鑒定合格的包裝容器的危險(xiǎn)貨物,不準(zhǔn)出口。
  
  第十六條 對(duì)裝運(yùn)出口易腐爛變質(zhì)食品的船艙和集裝箱,承運(yùn)人或者裝箱單位必須在裝貨前申請(qǐng)檢驗(yàn)。未經(jīng)檢驗(yàn)合格的,不準(zhǔn)裝運(yùn)。
  
  
  
  第四章 監(jiān)督管理
  
  第十七條 商檢機(jī)構(gòu)對(duì)本法規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)出口商品以外的進(jìn)出口商品,可以抽查檢驗(yàn)。出口商品經(jīng)抽查檢驗(yàn)不合格的,不準(zhǔn)出口。
  
  第十八條 商檢機(jī)構(gòu)根據(jù)檢驗(yàn)工作的需要,可以向列入《種類表》的出口商品的生產(chǎn)企業(yè)派出檢驗(yàn)人員,參與監(jiān)督出口商品出廠前的質(zhì)量檢驗(yàn)工作。
  
  第十九條 商檢機(jī)構(gòu)可以根據(jù)國(guó)家商檢部門同外國(guó)有關(guān)機(jī)構(gòu)簽訂的協(xié)議或者接受外國(guó)有關(guān)機(jī)構(gòu)的委托進(jìn)行進(jìn)出口商品質(zhì)量認(rèn)證工作,準(zhǔn)許在認(rèn)證合格的進(jìn)出口商品上使用質(zhì)量認(rèn)證標(biāo)志。
  
  第二十條 國(guó)家商檢部門和商檢機(jī)構(gòu)根據(jù)檢驗(yàn)工作的需要,通過考核,認(rèn)可符合條件的國(guó)內(nèi)外檢驗(yàn)機(jī)構(gòu)承擔(dān)委托的進(jìn)出口商品檢驗(yàn)工作。
  
  第二十一條 國(guó)家商檢部門和商檢機(jī)構(gòu)對(duì)其指定或者認(rèn)可的檢驗(yàn)機(jī)構(gòu)的進(jìn)出口商品檢驗(yàn)工作進(jìn)行監(jiān)督,可以對(duì)其檢驗(yàn)的商品抽查檢驗(yàn)。
  
  第二十二條 國(guó)家根據(jù)需要,對(duì)重要的進(jìn)出口商品及其生產(chǎn)企業(yè)實(shí)行質(zhì)量許可制度,具體辦法由國(guó)家商檢部門會(huì)同國(guó)務(wù)院有關(guān)主管部門制定。
  
  第二十三條 商檢機(jī)構(gòu)根據(jù)需要,對(duì)檢驗(yàn)合格的進(jìn)出口商品,可以加施商檢標(biāo)志或者封識(shí)。
  
  第二十四條 進(jìn)出口商品的報(bào)驗(yàn)人對(duì)商檢機(jī)構(gòu)作出的檢驗(yàn)結(jié)果有異議的,可以向原商檢機(jī)構(gòu)或者其上級(jí)商檢機(jī)構(gòu)以至國(guó)家商檢部門申請(qǐng)復(fù)驗(yàn),由受理復(fù)驗(yàn)的商檢機(jī)構(gòu)或者國(guó)家商檢部門作出復(fù)驗(yàn)結(jié)論。
  
  第二十五條 商檢機(jī)構(gòu)和其指定的檢驗(yàn)機(jī)構(gòu)以及經(jīng)國(guó)家商檢部門批準(zhǔn)的其他檢驗(yàn)機(jī)構(gòu),可以接受對(duì)外貿(mào)易關(guān)系人或者外國(guó)檢驗(yàn)機(jī)構(gòu)的委托,辦理進(jìn)出口商品鑒定業(yè)務(wù)。
  
  進(jìn)出口商品鑒定業(yè)務(wù)的范圍包括:進(jìn)出口商品的質(zhì)量、數(shù)量、重量、包裝鑒定,海損鑒定,集裝箱檢驗(yàn),進(jìn)口商品的殘損鑒定,出口商品的裝運(yùn)技術(shù)條件鑒定、貨載衡量、產(chǎn)地證明、價(jià)值證明以及其他業(yè)務(wù)。
  
  
  
  第五章 法律責(zé)任
  
  第二十六條 違反本法規(guī)定,對(duì)列入《種類表》的和其他法律、行政法規(guī)規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的進(jìn)口商品未報(bào)經(jīng)檢驗(yàn)而擅自銷售或者使用的,對(duì)列入《種類表》的和其他法律、行政法規(guī)規(guī)定必須經(jīng)商檢機(jī)構(gòu)檢驗(yàn)的出口商品未報(bào)經(jīng)檢驗(yàn)合格而擅自出口的,由商檢機(jī)構(gòu)處以罰款;情節(jié)嚴(yán)重,造成重大經(jīng)濟(jì)損失的,對(duì)直接責(zé)任人員比照刑法第一百八十七條的規(guī)定追究刑事責(zé)任。
  
  違反本法第十七條的規(guī)定,對(duì)經(jīng)商檢機(jī)構(gòu)抽查檢驗(yàn)不合格的出口商品擅自出口的,依照前款的規(guī)定處罰。
  
  第二十七條 偽造、變?cè)焐虣z單證、印章、標(biāo)志、封識(shí)、質(zhì)量認(rèn)證標(biāo)志,構(gòu)成犯罪的,對(duì)直接責(zé)任人員比照刑法第一百六十七條的規(guī)定追究刑事責(zé)任;情節(jié)輕微的,由商檢機(jī)構(gòu)處以罰款。
  
  第二十八條 當(dāng)事人對(duì)商檢機(jī)構(gòu)的處罰決定不服的,可以自收到處罰通知之日起三十天內(nèi),向作出處罰決定的商檢機(jī)構(gòu)或者其上級(jí)商檢機(jī)構(gòu)或者國(guó)家商檢部門申請(qǐng)復(fù)議;對(duì)復(fù)議決定不服的,可以自收到復(fù)議決定書之日起三十天內(nèi),向法院起訴。當(dāng)事人逾期不申請(qǐng)復(fù)議或者不起訴又拒不履行的,由作出處罰決定的商檢機(jī)構(gòu)申請(qǐng)法院強(qiáng)制執(zhí)行。
  
  第二十九條 國(guó)家商檢部門、商檢機(jī)構(gòu)的工作人員和國(guó)家商檢部門、商檢機(jī)構(gòu)指定的檢驗(yàn)機(jī)構(gòu)的檢驗(yàn)人員,濫用職權(quán),徇私舞弊,偽造檢驗(yàn)結(jié)果的,或者玩忽職守,延誤檢驗(yàn)出證的,根據(jù)情節(jié)輕重,給予行政處分或者依法追究刑事責(zé)任。
  
  
  
  第六章 附 則
  
  第三十條 商檢機(jī)構(gòu)和其他檢驗(yàn)機(jī)構(gòu)依照本法的規(guī)定實(shí)施檢驗(yàn)和辦理鑒定業(yè)務(wù),依照規(guī)定收費(fèi)。收費(fèi)辦法由國(guó)家商檢部門會(huì)同國(guó)務(wù)院有關(guān)主管部門制定。
  
  第三十一條 國(guó)家商檢部門根據(jù)本法制定實(shí)施辦法,報(bào)國(guó)務(wù)院批準(zhǔn)后施行。
  
  第三十二條 本法自1989年8月1日起施行。1984年1月28日國(guó)務(wù)院發(fā)布的《中華人民共和國(guó)進(jìn)出口商品檢驗(yàn)條例》同時(shí)廢止。
  
  
  
  附:刑法有關(guān)條文
  
  
  
  第一百八十七條 國(guó)家工作人員由于玩忽職守,致使公共財(cái)產(chǎn)、國(guó)家和人民利益遭受重大損失的,處五年以下有期徒刑或者拘役。

  Chapter I General Provisions
  
  Article 1This Law is enacted with a view to strengthening the inspection of importand export commodities, ensuring the quality of import and exportcommodities, protecting the lawful rights and interests of the partiesinvolved in foreign trade, and promoting the smooth development of China'seconomic and trade relations with foreign countries.Article 2The State Council shall establish an Administration for Import and ExportCommodity Inspection (hereinafter referred to as the State Administrationfor Commodity Inspection), which shall be in charge of the inspection ofimport and export commodities throughout the country. The local import andexport commodity inspection authorities (hereinafter referred to as thecommodity inspection authorities) set up by the State Administration forCommodity Inspection shall be responsible for the inspection of import andexport commodities within areas under their jurisdiction.Article 3The commodity inspection authorities and other inspection organizationsdesignated by the State Administration for Commodity Inspection and thecommodity inspection authorities shall, in accordance with the law,perform the inspection of import and export commodities.Article 4The State Administration for Commodity Inspection shall, in the light ofthe needs in the development of foreign trade, make, adjust and publish aList of Import and Export Commodities Subject to Inspection by theCommodity Inspection Authorities (hereinafter referred to as the List ofCommodities).Article 5Import and export commodities which are included in the List ofCommodities and import and export commodities subject to inspection by thecommodity inspection authorities under other laws or administrative rulesand regulations must be inspected by the commodity inspection authoritiesor inspection organizations designated by the State Administration forCommodity Inspection or the commodity inspection authorities. Nopermission shall be granted for the sale or use of import commoditiesspecified in the preceding paragraph until they have undergone inspection;and no permission shall be granted for the export of export commoditiesspecified in the preceding paragraph until they have been found to be upto standard through inspection.Import and export commodities specified in the first paragraph of thisArticle may be exempted from inspection upon the examination and approvalof an application from the consignee or consignor by the StateAdministration for Commodity Inspection.
  
  Article 6Inspection on import and export commodities performed by the commodityinspection authorities shall cover quality, specifications, quantity,weight, packing and the requirements for safety and hygiene.Import and export commodities governed by compulsory standards or otherinspection standards which must be complied with as provided for by lawsor administrative rules and regulations shall be inspected in accordancewith such inspection standards; in the absence of such stipulations,import and export commodities shall be inspected in accordance with theinspection standards agreed upon in the foreign trade contracts.Article 7Import and export commodities or items subject to inspection by otherinspection organizations under laws or administrative rules andregulations shall be inspected in accordance with the provisions ofrelevant laws or administrative rules and regulations.Article 8The State Administration for Commodity Inspection and the commodityinspection authorities shall collect information on the inspection ofimport and export commodities and make it available to the relevantcircles.
  Chapter II Inspection of Import Commodities
  
  Article 9For import commodities which are subject to inspection by the commodityinspection authorities in accordance with this Law, the consignee mustregister them with the commodity inspection authorities located at theport of discharge or the station of arrival. Import commodities which areincluded in the List of Commodities shall be checked and released by theCustoms upon presentation of the seal of the commodity inspectionauthorities affixed to the Customs declaration.Article 10For import commodities which are subject to inspection by the commodityinspection authorities in accordance with this Law, the consignee shallapply to the same authorities for inspection in places and within the timelimit specified by them. The commodity inspection authorities shallaccomplish the procedures for inspection and issue an inspectioncertificate within the period of validity of claims prescribed in aforeign trade contract.Article 11If import commodities other than those which are subject to inspection bythe commodity inspection authorities in accordance with this Law are foundto be not up to the quality standard, damaged or short on weight orquantity, the consignee shall apply to the commodity inspectionauthorities for inspection and the issuance of an inspection certificateif such a certificate is necessary for claiming compensation.Article 12For important import commodities and a complete set of equipment in largesize, the consignee shall, in accordance with the terms agreed upon in aforeign trade contract, conduct initial inspection or initial supervisionover manufacturing or loading in the exporting country before shipment,while the relevant competent departments shall strengthen theirsupervision. The commodity inspection authorities may, when necessary,dispatch inspection personnel to take part in such inspection andsupervision.
  Chapter III Inspection of Export Commodities
  
  Article 13For export commodities which are subject to inspection by the commodityinspection authorities in accordance with this Law, the consignor shallapply to the same authorities for inspection in the places and within thetime limit specified by them. The commodity inspection authorities shallaccomplish the procedures for inspection and issue a certificate withoutdelaying the prescribed time for shipment. Export commodities which areincluded in the List of Commodities shall be checked and released by theCustoms upon presentation of the inspection certificate or the paper forrelease issued by the commodity inspection authorities or the seal of thesame authorities affixed to the Customs declaration.Article 14Export commodities which have been inspected and passed by the commodityinspection authorities and for which an inspection certificate or a paperfor release has been issued by the same authorities shall be declared forexport and shipped out of the country within the time limit specified bythe same authorities. Failing to meet the time limit shall entailreapplication for inspection.Article 15An enterprise manufacturing packagings for dangerous export goods mustapply to the commodity inspection authorities for a test of theperformance of such packagings. An enterprise producing dangerous exportgoods must apply to the same authorities for a test of the use ofpackagings. No permission shall be granted for the export of dangerousgoods kept in packagings which have not passed a test.Article 16For vessel holds or containers used for carrying perishable foods, thecarrier or the organization using the containers shall apply forinspection before loading. No permission shall be granted for loading andshipment until the relevant conditions are passed by the inspectors.
  
  
  Chapter IV Supervision and Administration
  
  Article 17The commodity inspection authorities may make a random inspection ofimport and export commodities beyond those subject to inspection by thecommodity inspection authorities in accordance with this Law. Nopermission shall be granted for the export of export commodities found tobe substandard in a random inspection.Article 18The commodity inspection authorities may, when necessary, assigninspection personnel to manufacturers of export commodities which areincluded in the List of Commodities to take part in supervision over thequality inspection of export commodities before they leave the factory.Article 19The commodity inspection authorities may undertake the qualitycertification of import and export commodities on the basis of agreementssigned between the State Administration for Commodity Inspection and theforeign bodies concerned or upon entrustment by the foreign bodiesconcerned. They may permit the use of quality certification marks onimport and export commodities which have been given quality certification.Article 20The State Administration for Commodity Inspection and the commodityinspection authorities shall, on the basis of the requirements in theirinspection, entrust competent inspection organizations at home and abroadwith the inspection of import and export commodities after examining theirqualifications.Article 21The State Administration for Commodity Inspection and the Commodityinspection authorities shall exercise supervision over the import andexport commodity inspection conducted by the inspection organizationsdesignated or approved by them and may make a random inspection of thecommodities which have been inspected by such organization.Article 22The State shall, when necessary, institute a quality licence system forimportant import and export commodities and their manufacturers. Thespecific measures thereof shall be drawn up by the State Administrationfor Commodity Inspection in conjunction with the relevant competentdepartments under the State Council.Article 23The commodity inspection authorities may, when necessary, place commodityinspection marks or sealings on import and export commodities proved to beup to standard through inspection.
  
  Article 24In case an applicant for the inspection of import and export commoditiesdisagrees with the results of inspection presented by the commodityinspection authorities, he may apply for reinspection to the sameauthorities, to those at the next higher level or to the StateAdministration for Commodity Inspection. The conclusion on reinspectionshall be made by the commodity inspection authorities or the StateAdministration for Commodity Inspection which has accepted the applicationfor reinspection.Article 25The commodity inspection authorities, the inspection organizationsdesignated by them and other inspection organizations approved by theState Administration for Commodity Inspection may handle the business ofsuperintending and surveying import and export commodities as entrusted byparties involved in foreign trade or by foreign inspection bodies.The scope of business of superintending and surveying import and exportcommodities shall cover: inspection of the quality, quantity, weight andpacking of import and export commodities; inspection of cargoes withrespect to general or particular average; inspection of container cargoes;damage survey of import cargoes; inspection of technical conditions forthe shipment of exports; measurement of dead tonnage; certification of theorigin or value of exports and other superintending and surveyingservices.
  
  Chapter V Legal Responsibility
  
  Article 26Anyone who, in violation of the relevant provisions of this Law, purposelymarkets or uses import commodities which are included in the List ofCommodities or subject to inspection by the commodity inspectionauthorities in accordance with other laws or administrative rules andregulations without having such commodities inspected, or purposelyexports export commodities which are included in the List of Commoditiesor subject to inspection by the commodity inspection authorities inaccordance with other laws or administrative rules and regulations withouthaving such commodities inspected and proved up to standard shall be finedby the commodity inspection authorities. If the circumstances are seriousand cause heavy economic losses, the criminal responsibility of thepersonnel directly responsible shall be investigated by applying mutatismutandis the provisions of Article 187 of the Criminal Law.Anyone who, in violation of the provisions of Article 17 of this Law,purposely exports export commodities which have been found substandardduring a random inspection by the commodity inspection authorities, shallbe punished in accordance with the provisions of the preceding paragraph.Article 27If the falsifying or remaking of the certificates or documents, seals orstamps, marks, sealings or quality certification marks for commodityinspection constitutes a crime, the criminal responsibility of thepersonnel directly responsible shall be investigated by applying mutatismutandis the provisions of Article 167 of the Criminal Law; if thecircumstances are minor, the offender shall be fined by the commodityinspection authorities.Article 28If a party refuses to accept the punishment decision of the commodityinspection authorities, he may, within 30 days of receiving the notice onthe punishment, apply for reconsideration to the same authorities whichhave made the punishment decision, to those at the next higher level or tothe State Administration for Commodity Inspection. If the party refusesto accept the decision on the reconsideration, he may, within 30 days ofreceiving the notice on the reconsideration decision, bring a suit norcomplies with the punishment decision within the prescribed time limit,the commodity inspection authorities which have made the punishmentdecision shall apply to a court of law for compulsory execution.Article 29Any functionary of the State Administration for Commodity Inspection or ofthe commodity inspection authorities or any of the inspection personnel ofthe inspection organizations designated by the State Administration forCommodity Inspection and the commodity inspection authorities who abuseshis power, commits irregularities for the benefit of his relatives orfriends, falsifies inspection results or fails to conduct inspection andissue a certificate within the time limit through dereliction shall,depending on the seriousness of the circumstances, be given administrativesanction, or his criminal responsibility shall be investigated accordingto law.
  
  Chapter VI Supplementary Provisions
  
  Article 30The commodity inspection authorities and other inspection organizationsshall collect fees according to relevant provisions for carrying outinspection or performing superintending and surveying services inaccordance with the provisions of this Law. The procedures for collectingfees shall be drawn up by the State Administration for CommodityInspection in conjunction with the competent departments under the StateCouncil.Article 31Rules for the implementation of this Law shall be formulated by the StateAdministration for Commodity Inspection and shall come into force afterbeing submitted to and approved by the State Council.Article 32This Law shall come into force as of August 1, 1989. The Regulations ofthe People's Republic of China on the Inspection of Import and ExportCommodities promulgated by the State Council on January 28, 1984 shall beinvalidated as of the same date.
